1. Types of Data We Collect

The items of Personal Data which we collect and use are set forth below. Among the items listed below, name, resident country, telephone number and email address, etc. are collected at the time when you subscribe to your MyMusicTaste membership. Other items of Personal Data are collected when you enter and save them in the course of using Services.
  • Name, resident country, telephone number, email address, birthday, credit card information (card number, expiry date, CVC), payment method information (account number, bank, name of account holder)
  • Resident city, timezone, favorite artists, SNS accounts (Facebook, Twitter, Google, VK), SNS account email address (only when SNS account information is provided)
  • Other automatically generated information: date and time of access, device information, service use log

Information You Provide to Us.

We retain information on your behalf, such as messages that you store on the Services. If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other content included in the e-mail, in order to send you a reply. If you participate in one of our surveys, we may collect additional Personal Data.We may also collect Personal Data at other points in our Site or Services that state that Personal Data is being collected. Any Personal Data that you share publicly (as described in PUBLICLY SHARED DATA) will be stored on our servers.

Information Collected from You About Others.

If you decide to invite a third party to register for the Services, we will collect your and the third party's names and e-mail addresses in order to send an e-mail and follow up with the third party. We may offer the ability to automatically collect third party names and e-mail address from your address books or contact lists on third party services, such Gmail, Facebook, or Twitter. You or the third party may contact us to request the removal of this information from our database.

2. Publicly Shared Data

Any information that you include in your public profile will be viewable by other users. When you post messages to the Services, the information contained in your posting will be stored on our servers and other users will be able to see it. Library Items will be viewable by other users; provided that you will be able to control through your Services privacy settings which type of user can view your Library Items. Any of your publicly shared information, content, or activity, such as messages you post through the Services to a Social Networking Site, might be viewable by users of Social Networking Sites, depending on your Services privacy settings. We are not responsible for the Personal Data you choose to post in your public profile, post in messages, send to other users, or otherwise publicly share.

3. Use of Your Data Per Legal Basis for Processing

General Use

  1. In general, Personal Data you submit to us is used either to respond to requests that you make, or to aid us in serving you better. The use of your Personal Data can be justified on the legal basis allowed under GDPR and in certain cases such use has several justification at the same time. We use your Personal Data as described below:

Creation of Anonymous Data

We may create Anonymous Data records from Personal Data by excluding information (such as your name) that make the data personally identifiable to you. We use this Anonymous Data to analyze request and usage patterns so that we may enhance the content of our Services and improve Site navigation. Team MyMusicTaste reserves the right to use Anonymous data for any purpose and disclose Anonymous Data to third parties in its sole discretion.

4. Disclosure of Your Personal Data

We may share your Personal Data with any member of our affiliated companies or selected third parties as set forth below. Except as otherwise stated in this Privacy Notice, we do not sell, trade, share, or rent the Personal Data collected from our Site or Services to third parties.
Affiliates (MYMUSICTASTE INC.)

All Personal Data which we collect and use will be shared with our affiliates for the purpose of renting overseas concert venues and issuing tickets for the same time period during which we will retain the data.

    • Retention and utilization period - Until withdrawal of membership and withdrawal of consent for handling personal information

    • Purpose of use - Update progress to fulfill the terms of the crowdfunding service and deliver goods
    • Items of personal information - Name, Email, Phone number, Address, and Postal code
  3. Pre-order Commodity Manufacturer and Distributor
    • Purpose of use - Update progress to fulfill the terms of the pre-order service and deliver goods
    • Items of personal information - Name, Email, Phone number, Address, and Postal code
  4. Shipping company (DHL, EFS, EMS, K-packet, etc)
    • Purpose of use - Shipment of goods
    • Items of personal information - Name, Email, Phone number, Address, and Postal code
  5. Customer Service Outsource Entity
    • Purpose of use - provide customer service regarding website usage, ticketing, event information and package shipment
    • Items of personal information - Name, Email, Phone number, Address, and Postal code

Other specific provider information related to crowdfunding and pre-order products will be released at the event.

Your personal information will be transferred to the trustee for processing personal information as shown in the table below.
  • Amazon Web Services - IT Infrastructure Management for Service
  • Periscope data - Analysis of Service Visits and Usage Records
  • Sendgrid - Service announcements, promotional emails and results analysis
  • Twilio - Phone number authentication, service announcements, promotional text messaging, and analysis of results
  • Kickbox - Valid email verification and fraud prevention when subscribing to services
  • Zendesk - Solving and managing the problem situation received from the customer
  • Stripe - Payment for crowdfunding and pre-order services
  • PayPal - Payment for crowdfunding and pre-order services
  • KakaoPay - Payment for crowdfunding and pre-order services
  • Alipay - Payment for crowdfunding and pre-order services

We will also disclose your information to third parties:
  • in the event that we sell any business or assets, in which case we will disclose your data to the prospective buyer of such business or assets; or
  • if we or substantially all of our assets are acquired by a third party, in which case information held by us about our users will be one of the transferred assets.

5. Retention Period of Your Personal Data

We will retain and use your Personal Data until you cancel your MyMusicTaste membership or withdraw your consent for processing your Personal Data. Upon such cancellation or withdrawal, we will remove your Personal Data without any delay unless there are legitimate interests to continue to retain such Personal Data or other regulations which prevent us from doing so.

6. Third Party Websites

When you click on a link to any other website or location, you will leave our Site and go to another site and another entity may collect Personal Data or Anonymous Data from you. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of this Privacy Notice does not apply to these outside websites or content, or to any collection of data after you click on links to such outside websites.

7. Your Rights and Choices Regarding Your Personal Data

Right

You have the right to ask MyMusicTaste to access the personal data MyMusicTaste holdS about you and be provided with certain information about how we use your personal data and who we share it with. You also have the right to ask MyMusicTaste to correct your personal data where it is inaccurate or incomplete.

In certain circumstances, you have the right to ask MyMusicTaste to delete the personal data we hold about you:
  • where you believe that it is no longer necessary for MyMusicTaste to hold your personal data (for example, if you decide that you no longer wish to submit a job application to MyMusicTaste)
  • where we are processing your personal data on the basis of legitimate interests and you object to such processing and we cannot demonstrate an overriding legitimate ground for the processing; or
  • where you believe the personal data we hold about you is being unlawfully processed by us.
  • In certain circumstances, you have the right to ask us to restrict (stop any active) processing of your personal data:where you believe the personal data MyMusicTaste holds about you is inaccurate and while we verify accuracy;
  • where MyMusicTaste want to erase your personal data as the processing is unlawful but you want us to continue to store it;
  • where MyMusicTaste no longer needs your personal data for the purposes of our processing but you require us to retain the data for the establishment, exercise or defence of legal claims; or
  • where you have objected to MyMusicTaste processing your personal data based on our legitimate interests and we are considering your objection.

In addition, you can object to our processing of your personal data based on our legitimate interests and we will no longer process your personal data unless we can demonstrate an overriding legitimate ground.

Please note that these rights are limited, for example, where fulfilling your request would adversely affect other individuals or Company trade secrets or intellectual property, where there are overriding public interest reasons or where we are required by law to retain your personal data.

Objection to Marketing

At any time you have the right to object to our processing of data about you in order to send you marketing, including where we build profiles for such purposes, and we will stop processing the data for that purpose. In particular, you have the right to object to any processing based on legitimate interests including direct marketing.

Choices

We offer you choices regarding the collection, use, and sharing of your Personal Data. With consent, where required by applicable law, we will periodically send you free newsletters and e-mails that directly promote the use of our Site or our Services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to "opt-out" by following the unsubscribe instructions provided in the e-mail you receive or by contacting us directly here. 8. Security of Your Personal Data

We have commercially reasonable security measures in place to help protect against loss, misuse and alteration of your Personal Data in our possession. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while Team MyMusicTaste uses reasonable efforts to protect your Personal Data, Team MyMusicTaste cannot guarantee its absolute security.

9. The Use of Automated Decision Making

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. You can object to your personal data being used in this way. We are permitted to use automated decision-making and profiling if the decision:
  • is necessary for entering into, or performance of, a contract between you and us;
  • s authorised by EU or a member state law to which we are subject and which also lays down suitable measures to safeguard your rights and freedoms and legitimate interests; or
  • is based on your explicit consent.

Where we engage in automatic decision-making or profiling in connection with a contract between us or further to your explicit consent, we implement suitable measures to safeguard your rights and freedoms and legitimate interests, at least the right to obtain human intervention from us in the course decision-making process, and the opportunity to express your point of view and to contest the decision.

Privacy Shield Principle

The privacy principles in this Policy are based on the Privacy Shield Principles.
Notice: Where we collect Personal Data directly from individuals in the EU , we will inform them about:
  • our participation in the Privacy Shield and the web address for the Privacy Shield list;
  • the types of Personal Data collected and the purposes for which we collect and use that information;
  • our commitment to apply the Privacy Shield Principles to all Personal Data received from the EU under the Privacy Shield;
  • how to contact us with any inquiries or complaints;
  • the type of Agents to which we disclose Personal Data, and for what purposes;
  • their right to access their own personal data;
  • the independent dispute resolution body (the ICDR/AAA (American Arbitration Association), an alternative dispute resolution provider based in the United States) we have designated to address complaints, free of charge to a complainant;

Where we receive Personal Data from our subsidiaries, affiliates or other entities in the EU, we will use and disclose such information in accordance with the notices provided by such entities and the choices made by individuals regarding their Personal Data.

Choice: We do not use Personal Data for purposes other than for those for which it was collected. We do not share such information with non-Agent third parties, unless required by law.

Accountability for Onward Transfer (transfers to Agents): We only transfer Personal Data to Agents for limited and specified purposes, consistent with any notice provided to you and consent given. We transfer Personal Data to Agents only if the Agent agrees to provide the same level of privacy protection as is required by this Policy and Privacy Shield Principles. We require Agents to notify us if they determine that they can no longer provide the protections required by the Privacy Shield Principles. Where we know an agent is using or disclosing Personal Data in a manner contrary to the Privacy Shield Principles, we will take all reasonable steps to stop and remediate unauthorized processing of Personal Data. In cases of onward transfer to third parties of data of EU individuals received pursuant to the EU-U.S. Privacy Shield, GHI is potentially liable.

Security: We take all reasonable precautions to protect Personal Data in our possession from loss, misuse and unauthorised access. In addition, we will take all reasonable steps to prevent unauthorised disclosure, alteration and destruction of Personal Data.

Data Integrity and Purpose Limitation: We will use Personal Data only in ways that are compatible with the purposes for which it was collected or subsequently authorised by the individual. We will take all reasonable steps to ensure that Personal Data we process is limited to only what is relevant to the purposes for which it was collected and that it is accurate, complete, and up-to-date.

Access: Upon request, we will grant individuals reasonable access to Personal Data that we hold about them, which consists mainly of information received from our customers. In addition, we will take reasonable steps to permit individuals to correct, amend, or delete information that is inaccurate, incomplete, or has been processed in violation of Privacy Shield Principles (except when the burden or expense of providing access, correction, amendment, or deletion would be disproportionate to the risks to the individual’s privacy, or where the rights of persons other than the individual requesting the data would be violated). We are unable to correct anything other than factual errors in any report we produce for our customers because the report is based on information provided by such customers. However, we will take all reasonable steps to facilitate amendments to information provided by our customers if an individual raises a query.

Recourse, Enforcement and Liability: We will conduct compliance audits of our relevant privacy practices, for example our information and data processing systems, to verify adherence to this Policy. Any employee that we determine is in violation of this Policy will be subject to disciplinary action up to and including termination of employment.

Transfers of Personal Information out of the EEA

MyMusicTaste employs appropriate safeguards for cross-border transfers of personal data, as required by EU-U.S. Privacy Shield - U.S. Privacy Shield Frameworks.

MyMusicTaste also complies with the EU-U.S. Privacy Shield Framework – U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States, respectively. MyMusicTaste has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Independent Recourse Mechanism for Privacy Shield Complaints

In compliance with the Privacy Shield Principles, MyMusicTaste commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact MyMusicTaste at: privacy@mymusictaste.com. MyMusicTaste has further committed to refer unresolved Privacy Shield complaints to ICDR/AAA , an alternative dispute resolution provider located in the United States. However, we will normally collect personal information from you only where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms, or where we have your consent to do so. Information From Children

We do not knowingly permit children (under the age of 13 in the US or 16, if you live in the EEA) to sign up for a MyMusicTaste account. If we discover someone who is underage has signed up for a MyMusicTaste account, we will take reasonable steps to promptly remove that person’s personal information from our records. If you believe a person who is underage has signed up for a MyMusicTaste account, please contact us at privacy@mymusictaste.com.
The company will use the collected e-mail addresses of parents and relatives to prepare for obtaining consent to join and use this service for members under age.

This Privacy Notice is subject to occasional revision, and if we make any material changes to this Privacy Notice, we will notify you by sending you an e-mail to the last e-mail address you provided to us and/or by prominently posting notice of the changes on our Site (which you should check at frequent intervals). Any changes to this Privacy Notice will be effective upon the earlier of five to seven (5-7) calendar days following our dispatch of an e-mail notice to you or five to seven (5-7) calendar days following our posting of notice of the changes on our Site. These changes will be effective immediately for new users of our Service. Please note that at all times you are responsible for updating your Personal Data to provide us with your most current e-mail address.
